The internet sales of our products are identified as distance contracts, therefore governed according to Legislative Decree n. 206/05 (art. From 50 to 68) which regulates the matter of distance contracts, i.e. carried out outside business premises. If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number in the order form to Argentum Gioelli), he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. To exercise this right, the Customer must send Argentum Gioielli a written communication to that effect, and within 14 working days from the date of receipt of the goods, also arrange for the shipment of the aforementioned goods purchased at the Argentum SaS headquarters of Agostino Capuozzo e C. - Via Antonio Scialoia N ° 15, 80133 Naples.
The communication of the withdrawal must be sent by registered letter with acknowledgment of receipt, addressed to Argentum SaS di Agostino Capuozzo e C. - Via Antonio Scialoia N ° 15, 80133 Naples or by telegram or fax always sent within the aforementioned terms by registered letter with notice of receipt. Once the aforementioned notice of withdrawal has been sent, the customer is required to return the goods no later than 14 days from the date of the postmark on the registered letter. the customer must take care to return the goods by indicating on the package their data such as name, address and telephone number and the reference order number.
The right of withdrawal is however subject to the following conditions
- The law applies to the product purchased in its entirety;
- It is not possible to exercise withdrawal only on part of the purchased product;
- The purchased good must be intact and returned in its original packaging, complete in all its parts (including any documentation and accessory equipment);
- Shipping costs are charged to the customer;
- The shipment, until the certificate of receipt in our warehouse is under the full responsibility of the Customer;
- In case of damage to the goods during transport, Argentum Gioielli will notify the Customer of the incident (within the working day following receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain the reimbursement of the value of the asset (if insured);
- in this case, the product will be returned, with shipping costs charged to the customer, simultaneously canceling the request for withdrawal;
The right of withdrawal is totally lost, for lack of the essential condition of integrity of the asset (packaging and / or its contents), in cases where Argentum Gioielli ascertains:
- The lack of the original external / internal packaging;
- The absence of integral elements of the product;
- Damage to the product for reasons other than its transport or for exceeding the time limits established by law for reasons not deriving from Argentum Gioielli.
In case of forfeiture of the right of withdrawal, Argentum Gioielli will return the purchased good to the sender, charging the shipping costs to the sender.
The right of withdrawal by the Customer does not apply in the event that the withdrawal of the goods has been collected and paid for in one of the points of sale as in this case the transaction is transformed into a simple reservation completed in purchase at the time of issue of the receipt or invoice from the shop.
It cannot therefore be considered a transaction concluded online or by mail order and the relationship is maintained with the owner of the affiliated shop in normal business premises.
Applicable law and competent court
These General Conditions and the relations between Argentum Gioielli and the consumer are governed by the law of the Italian Republic. Any dispute inherent, deriving from or in any case connected to these General Contract Conditions will be referred to the jurisdiction of the Court of the Argentum Gioielli registered office, which the Civil Court of Naples is elected to all effects, notwithstanding the law.
